This briefing draws on the latest available data to analyse the implementation and application of Regulation 261/2004 which introduces common rules on assistance and compensation to air passengers when their travel is disrupted. The briefing explains why the European Union enacted air passenger rights and the current state of play in terms of their enjoyment. It further sets out the current legal framework before exploring its shortcomings. Finally, it gives examples of best practice and presents some recommendations for national parliaments and EU institutions to improve the enforcement of citizens’ rights.

CJEU Opinion on EU-Canada PNR agreement

A new agreement on the transfer of passenger name records (PNR) was signed by the EU Council and Canada in 2014, but conclusion of the agreement requires the European Parliament's consent. Consulted by Parliament, the Court of Justice of the EU held in July 2017 that the envisaged agreement needs to be revised.

The compromise text on the long-debated proposal for an EU PNR (Passenger Name Records) Directive is now due to be voted in plenary in April. It aims at uniformly regulating the processing and sharing of passenger name records by Member States in the fight against terrorism and serious crimes, while putting in place a series of data protection safeguards.

Cost of Non-Europe Reports identify the possibilities for economic or other gains and/or the realisation of a ‘public good’ through common action at EU level in specific policy areas and sectors. This report analyses the costs for citizens and business of the absence of a consolidated framework for Passenger Rights as well as the feasibility and the merits of such a consolidation in a single legislative instrument.Regulatory and practical gaps and inconsistencies in EU passenger legislation result in passengers not being equally protected across the various transport modes. The lack of a consolidated and consistent framework weakens the effective enforcement of Passenger Rights, affects the quality of service and creates barriers for seamless travel. The costs of these shortcomings for transport users and the whole society amount to at least 355 million euro annually.Although requiring a complex legislative effort, the establishment of a single EU framework for passenger rights in the form of an EU Codex would present the highest added value in tackling the current problems.  A Common Frame of Reference could be a first step to such consistent and harmonised revision of Passenger Rights.

'Foreign fighters' - Member States' responses and EU action in an international context

As the hostilities in Syria and Iraq continue and terrorism activities worldwide seem to be on the rise, EU Member States are increasingly confronted with the problem of aspiring and returning 'foreign fighters'. Whereas the phenomenon is not new, its scale certainly is, which explains the wide perception of these individuals as a serious threat to the security of both individual Member States and the EU as a whole. As the hostilities in Syria and Iraq continue and terrorism activities worldwide seem to be on the rise, EU Member States are increasingly confronted with the problem of aspiring and returning 'foreign fighters'. Whereas the phenomenon is not new, its scale certainly is, which explains the wide perception of these individuals as a serious threat to the security of both individual Member States and the EU as a whole. The problem has been addressed within international fora including the United Nations, which in 2014 adopted a binding resolution specifically addressing the issue of foreign fighters. The EU is actively engaged in relevant international initiatives. Within the EU, security in general and counter-terrorism in particular have traditionally remained in the Member States' remit. The EU has however coordinated Member States' activities regarding the prevention of radicalisation, the detection of suspicious travel, criminal justice response and cooperation with third countries. The EU is seeking to strengthen its role given the widely shared feeling of insecurity in the wake of recent terrorist attacks. Existing and new paths for EU action are being explored, including the revived EU passenger name records (PNR) proposal. Individual Member States have stepped up their efforts to address the problem using various kinds of tools including criminal law, administrative measures and 'soft tools', such as counter-radicalisation campaigns. The Member States most affected have also cooperated with each other outside the EU framework. The United States has a particularly developed counter-terrorism framework now being used to deal with foreign fighters. Since 9/11, the EU and the US have cooperated on counter-terrorism despite different philosophies on issues such as data protection.

This Cost of Non-Europe Report seeks to analyse the costs for citizens, businesses and relevant stake-holders of remaining gaps and barriers in the Single Market in transports, as well as to examine the benefits from further action in the tourism sector. This particular study - the third in a series - looks at the cost of non-Europe in European tourism policy and passenger rights legislation. For passenger rights, it analyses existing legislation and policy measures, identifying specific gaps where legislation or further initiatives at European level could be beneficial. In the tourism area, it quantifies in economic terms the potential for efficiency gains and identifies the main areas, in which EU action would further support the development of tourism and help realise the potential gains identified.
