The legal nature of Country-Specific Recommendations

The Country-Specific Recommendations (CSRs) are annually adopted by the Council based on the Commission (COM) proposals within the framework of the European Semester. The CSRs provide integrated guidance on macro-fiscal and macro-structural measures based on the COM assessment of Member States' medium-term budgetary plans and national reform programmes in light of broad policy priorities endorsed by the European Council or adopted by the Council on th basis of the Annual Growth Survey. The Council also adopts policy recommendations to the euro area as a whole in accordance with Article 136 of the Treaty on the Functioning of the European Union (TFEU) following a COM proposal. Table 1 displays the development of the number of CSRs and the minimum and maximum number per Member State.

Wprowadzając akty delegowane i wykonawcze traktat lizboński (2007) zreformował system przyznawania Komisji uprawnień do przyjmowania środków innych niż ustawodawcze. Niemniej do nowego systemu nie dostosowano jednego rodzaju aktów sprzed Traktatu z Lizbony, określanego jako „środki w ramach procedury regulacyjnej połączonej z kontrolą”. W następstwie wniosków Komisji z grudnia 2016 r. przewiduje się dostosowanie do traktatu lizbońskiego niektórych aktów odnoszących się do procedury regulacyjnej połączonej ...

Po osiągnięciu porozumienia z Radą w sprawie 64 aktów Parlament ma głosować nad wnioskami podczas drugiej kwietniowej sesji plenarnej.

Długoterminowy plan w zakresie połowów dorsza

W 2012 r. Rada postanowiła o szeregu środków zmieniających plan zarządzania połowami obejmujący liczne zasoby dorsza w morzach europejskich. To wyłączne rozporządzenie Rady zostało unieważnione przez Trybunał Sprawiedliwości, a Parlament Europejski ma obecnie przyjąć nowe rozporządzenie oparte na podstawie prawnej właściwej dla „współdecyzji” w celu dostosowania planu zarządzania połowami.

This can be explained as the remit of EU foreign policy is not easy to identify, since it brings together missions for which the EU has full responsibility and competences shared with EU Member States, or even the UN or WTO. However, since its inception, EU foreign policy has adapted to an ever-changing ...

Citizens who think EU engagement in foreign policy is sufficient are almost as numerous as those wishing the EU does more in this area – and nearly one fifth confess they are not able to evaluate EU action. This can be explained as the remit of EU foreign policy is not easy to identify, since it brings together missions for which the EU has full responsibility and competences shared with EU Member States, or even the UN or WTO. However, since its inception, EU foreign policy has adapted to an ever-changing global context: most international issues have multiple impacts – on climate, migration flows or security – and need to be comprehensively addressed. Building on the Treaties’ provisions, the EU and its Member States are moving from ‘silo’ policies (trade, development, humanitarian aid) towards more integrated strategies.

Although significantly strengthened by the Treaty of Lisbon, this policy area continues to be hampered by the Member States' lack of will to make better use of the existing legal framework, and by inadequate funding mechanisms.

In areas where the public feel that EU intervention is most effective – notably ensuring equal pay, facilitating work-life balance and combating violence against women – there is scope for further action at national and EU level, ranging from ‘soft’ measures such as awareness-raising campaigns to better implementation and enforcement of existing equal treatment legislation, and the potential introduction of new legislative proposals. A number of initiatives are already on the table, but stakeholders have also expressed concerns about diminishing commitment to gender equality policy at EU level.
