This note provides an overview of the main features and recent developments regarding the advisory European Fiscal Board. This body was established by the European Commission in October 2015, in the context of the implementation of an “integrated framework for sound fiscal policies”, proposed in the Five Presidents' Report of June 2015. The Annex presents excerpts from the latest Annual Reports published by the board.

This note provides an overview of the country-specific recommendations issued annually to EU Member States under the European Semester for economic policy coordination. It presents how these recommendations evolved over time (2012-2019), including from the legal base perspective. Finally, it shows how recommendations were implemented over the 2012-2018 European Semester cycles. The note is updated on a regular basis.

The legal nature of Country-Specific Recommendations

The Country-Specific Recommendations (CSRs) are annually adopted by the Council based on the Commission (COM) proposals within the framework of the European Semester. The CSRs provide integrated guidance on macro-fiscal and macro-structural measures based on the COM assessment of Member States' medium-term budgetary plans and national reform programmes in light of broad policy priorities endorsed by the European Council or adopted by the Council on th basis of the Annual Growth Survey. The Country-Specific Recommendations (CSRs) are annually adopted by the Council based on the Commission (COM) proposals within the framework of the European Semester. The CSRs provide integrated guidance on macro-fiscal and macro-structural measures based on the COM assessment of Member States' medium-term budgetary plans and national reform programmes in light of broad policy priorities endorsed by the European Council or adopted by the Council on th basis of the Annual Growth Survey. The Council also adopts policy recommendations to the euro area as a whole in accordance with Article 136 of the Treaty on the Functioning of the European Union (TFEU) following a COM proposal. Table 1 displays the development of the number of CSRs and the minimum and maximum number per Member State.

The Stability and Growth Pact (SGP) is the legal framework (based on primary and secondary EU law) that seeks to ensure sustainable public finances in the interest of the stability of the Economic and Monetary Union (EMU). It consists of two main building blocks: the preventive arm and the corrective arm. Stylised overviews, including on flexibility provisions (endorsed by the Council) within the existing rules of the SGP, are provided in the annexes. The main sources used in this briefing are primary Union law (Articles 121 and 126 of the Treaty on the Functioning of the European Union), secondary Union law (the amended Regulations (EC) 1466/97 and 1467/97 as well as the Regulation (EU) No 1173/2011), the Code of Conduction on the implementation of the SGP and the Commission Communication entitled ‘Making the best use of flexibility within the existing rules of the SGP’.

To facilitate the parliamentary scrutiny work, the Committee on Economic and Monetary Affairs (including its Banking Union Working Group) has drawn on external experts to provide briefings on topics of relating to both the SSM and SRM. Prior to December 2015, experts had been requested on an ad-hoc basis, while thereafter, ECON could draw on expertise from two standing panels of experts, one panel for supervisory issues, the other for questions related to bank resolution. Prior to December 2015, experts had been requested on an ad-hoc basis, while thereafter, ECON could draw on expertise from two standing panels of experts, one panel for supervisory issues, the other for questions related to bank resolution. Topics for the panel of experts to be provided in advance of each public hearing are chosen by ECON Coordinators. Since their inception, the two standing panels have in total provided 56 concise written briefing papers on 20 different topics.

The table overleaf compares the draft 2019 Country Specific Recommendations (CSRs) proposed by the Commission on 5 June 2019 with the 2019 CSRs adopted by the Council on 9 July 2019. The comparison is provided in order to facilitate the assessment of the "comply or explain" rule stipulated in Article 2-ab(2) of EU Regulation No 1175/2011: "The Council is expected to, as a rule, follow the recommendations and proposals of the Commission or explain its position publicly". The table overleaf provides an overview of all modifications introduced by the Council. When compared against the Commission text, the strikethrough yellow text has been deleted from the Council text, while the green text has been added to the Council text.
