This briefing provides an initial analysis of the strengths and weaknesses of the European Commission's impact assessment (IA) accompanying the above-mentioned proposal, submitted on 15 December 2020 and referred to the Committee on Internal Market and Consumer Protection (IMCO) of the European Parliament. The proposal is part of the digital services act package, which includes the digital services act itself. In her political priorities for the European Commission, President Ursula von der Leyen committed to upgrade the liability and safety rules for digital platforms, services and products, and complete the digital single market. The 2020 Commission work programme also included a commitment to establish an ex-ante competition tool to make Europe fit for the digital age.

The Commission is proposing a European Data Governance Act as the first of a series of measures envisaged in the 2020 European Strategy for Data. This initial appraisal of the Commission’s impact assessment on the proposal finds that the impact assessment traces a clear intervention logic, connecting problems and their drivers with specific objectives and policy options. The IA process appears to provide a reliable assessment underpinned by a mix of reliable qualitative and quantitative data and analysis. It is felt however that the IA as a self-standing document does not do justice to the considerable data collection and analysis effort that seems to be behind it and a true idea of the substantial process undertaken can only be had if the IA is read in conjunction with the underlying support study.

Member States have adopted a range of emergency measures in response to the unprecedented public health crises generated by the coronavirus pandemic. Whereas not all Member States dispose of constitutional mechanisms to enable the declaration of a 'state of emergency', all have taken exceptional and far-reaching emergency measures that affect citizens' rights and freedoms as well as democratic processes. Member States have adopted a range of emergency measures in response to the unprecedented public health crises generated by the coronavirus pandemic. Whereas not all Member States dispose of constitutional mechanisms to enable the declaration of a 'state of emergency', all have taken exceptional and far-reaching emergency measures that affect citizens' rights and freedoms as well as democratic processes. These institutional changes and the restrictions imposed on citizens' lives pose significant institutional and democratic challenges. Given their impact on fundamental rights and freedoms and on the normal functioning of democracy, emergency measures need to be carefully examined, matched with adequate legal safeguards, and subject to close democratic scrutiny. This is particularly true in the context of rapid changes of circumstances and in view of new evidence about the evolution of the crisis and its implications. This briefing covers the following countries: Bulgaria, Estonia, Latvia, Malta, Austria, Romania, and Slovenia. It focuses on three key aspects: i) the constitutional framework of the state emergency or legitimation of the emergency legislation; ii) the concrete measures adopted; and iii) the extent of parliamentary oversight exercised on the adopted measures. This briefing is the second in a series aimed at providing a comparative overview of Member States' institutional responses to the coronavirus crisis. The first in the series covered an initial set of seven Member States.

The Impact assessment is particularly sensitive to concerns of encroachment on fundamental rights and freedoms and makes a distinctive effort to highlight the proportionality of the measures proposed and the safeguards to fundamental rights and freedoms integrated within.

This initial appraisal of the Commission’s impact assessment on the proposals acknowledges the necessity for impact assessments in relation to financial framework programmes to have a simplified format and scope differing from standard impact assessments and that the document in question sets out the rationale for the new instruments and explains the choices made in their design. It finds however that the level of analysis conducted and the measure of the departure from the standard methodology and format of impact assessments weaken its potential to inform decision-making.

This initial appraisal of the Commission’s impact assessment on the proposal observes that the impact assessment is characterised by a lack of quantitative evidence and this is acknowledged explained by the impact assessment itself. The IA, however, still seems to make a reasonable case for the proposal on the basis mostly of legal analysis and supported by anecdotal evidence gathered through the stakeholder consultation.
