This study was requested by the European Parliament’s Committee on Petitions. It was written and published by the Policy Department for Citizens’ Rights and Constitutional Affairs. The paper describes the methods and procedures of cooperation between the Committee on Petitions and other parliamentary committees on petitions sent for opinion and information and examines improvements brought by the establishment of the Petitions Network. The study analyses impact of petitions on the activities of the parliamentary committees and describes follow-up actions to integrate EU citizens concerns in the parliamentary work. It raises areas for improvement and proposes recommendations to strengthen cooperation between committees.

On the International Women’s Day, let us recall the context in which the current event is taking place. Just about a year ago, the World Health Organisation proclaimed the COVID 19 as the global pandemics. In the scope of several weeks, it has affected all the countries in the world and persists until this day, in spite of the existence of vaccines. Hence, further societal developments are uncertain and more changes within it are to be expected. The right to asylum is a fundamental right and recognising the refugee status where the criteria are fulfilled is an international obligation, first recognised in the 1951 Geneva Convention on the protection of refugees and the Protocol of 31 January 1967 relating to the status of refugees. In the EU, an area of open borders and freedom of movement, Member States need to have a joint approach to guarantee high standards to persons in need of international protection through establishment of a Common European Asylum System based on fundamental rights. The European Parliament always strongly promoted a Common European Asylum System in accordance with the Union’s legal commitments. The Parliament worked as well as for the reduction of illegal migration as well as for the protection of vulnerable groups. In 2015, the unprecedented high number of arrivals of refugees and irregular migrants in the EU exposed a series of deficiencies and gaps in Union policies on asylum. Therefore, the European Commission proposed in May and July 2016 a third package of legislation to reform of the Common European Asylum System. and the European Parliament took an active part as a co-legislator to achieve this objective.

Postopke za izvolitev poslancev Evropskega parlamenta urejajo evropska zakonodaja, ki določa pravila, skupna vsem državam članicam, ter posebni nacionalni predpisi, ki se med državami članicami razlikujejo. Skupna pravila določajo načelo proporcionalne zastopanosti, pravila o pragu in nekatere primere nezdružljivosti z mandatom poslanca Evropskega parlamenta. Nacionalni zakoni urejajo številne druge pomembne vidike, na primer točno kakšen volilni sistem se uporablja in koliko je volilnih enot.

Prve pogodbe

Francosko-nemška sprava je bila zaradi katastrofalnih posledic druge svetovne vojne in nenehne nevarnosti spopada med vzhodom in zahodom bistvena. Povezovanje premogovništva in jeklarske industrije šestih evropskih držav, vzpostavljeno na podlagi pariške pogodbe iz leta 1951, je bil prvi korak na poti združevanja Evrope. Rimski pogodbi sta leta 1957 utrdili temelje tega združevanja in okrepili zamisel o skupni prihodnosti šestih evropskih držav.

Razvoj do Enotnega evropskega akta

Največji dosežki prvih pogodb se nanašajo na oblikovanje lastnih sredstev Skupnosti, večje proračunske pristojnosti Parlamenta, splošne neposredne volitve v Evropski parlament in oblikovanje evropskega monetarnega sistema. Enotni evropski akt, ki je začel veljati leta 1986 in je bistveno spremenil Rimsko pogodbo, je okrepil evropsko povezovanje z oblikovanjem obsežnega notranjega trga.

Maastrichtska in amsterdamska pogodba

Maastrichtska pogodba je spremenila predhodne evropske pogodbe in oblikovala Evropsko skupnost, ki temelji na treh stebrih: Evropskih skupnostih, skupni zunanji in varnostni politiki (SZVP) ter sodelovanju na področjih pravosodja in notranjih zadev (PNZ). Amsterdamska pogodba je uvedla spremembe, ki so bile potrebne zaradi širitve Evropske unije, ter zagotovila bolj učinkovito delovanje in bolj demokratično Unijo.

Pogodba iz Nice in Konvencija o prihodnosti Evrope

Pogodba iz Nice je Evropsko unijo le deloma pripravila na pomembne širitve proti vzhodu in jugu 1. maja 2004 in 1. januarja 2007. Konvencija o prihodnosti Evrope si je zato v odgovor na vprašanja, postavljena v laekenski deklaraciji, prizadevala za pripravo nove pravne podlage za Unijo v obliki pogodbe o ustavi za Evropo. Zaradi neuspelih referendumov v dveh državah članicah ta pogodba ni bila ratificirana.

Pogodba iz Nice je Evropsko unijo le deloma pripravila na pomembne širitve proti vzhodu in jugu 1. maja 2004 in 1. januarja 2007.
