Protection of the Union's budget in case of 'rule of law' deficiencies

On 10 December 2020, the European Council reached an agreement on the implementation of the regulation linking EU funding to respect for the rule of law. Hungary and Poland, in opposing this new mechanism, had been blocking the Union’s new budget but have now agreed to a compromise. The regulation on the rule of law is part of the package on the multiannual financial framework (MFF) for 2021-2027 and the Next Generation EU recovery instrument. The Parliament is due to vote in December at second reading on the agreed text.

Parliament's consent to the 2021-2027 MFF

During the December part-session, Parliament is due to vote on giving consent to the Council Regulation that establishes the EU's next multiannual financial framework (MFF). Parliament consent requires a majority of its component Members (353 votes). Cooperation between the European Anti-Fraud Office and the European Public Prosecutor's Office

The establishment of the European Public Prosecutor's Office (EPPO) with the entry into force of the EPPO Regulation of 12 October 2017 requires the regulation governing investigations by the European Anti-Fraud Office (OLAF) to be adapted. In 2018, the Commission adopted a proposal to revise the OLAF Regulation as regards cooperation with the EPPO and the effectiveness of OLAF investigations. CAP transitional rules for 2021 and 2022

The lengthy negotiations on the EU budget and farm policy post-2020 convinced the European Commission to put forward rules in 2019 to ensure continuity of EU support for farmers and rural areas. The European Parliament is set to debate and vote on these transitional rules, extending current EU farm policy until the new common agricultural policy framework is in place (i.e. until the end of 2022), during the December plenary session.

Draft Amending Budget N°9/2020 (DAB 9/2020) accompanies the proposal to mobilise the European Union Solidarity Fund (EUSF) for a total of €823.5 million to provide assistance to Croatia and Poland in relation to natural disasters, and advance payments to seven Member States relating to a public health emergency. Gender budgeting has a fundamental impact on inclusive and economic growth, fostering employment, reducing poverty, addressing ageing population and increasing Gross Domestic Product (GDP). According to the study of the European Institute for Gender Equality (EIGE), the estimated impact of improved gender equality varies considerably across member states from 4% to 12% of GDP, depending on the present level of achievement of gender equality.

The EU is in the process of adapting its budgetary instruments to respond to the consequences of the coronavirus crisis, in particular in raising the established ceilings for some financial instruments. The proposed adjustments include, among other things, measures aimed at helping the most fragile third countries recover from the consequences of the pandemic. In particular, on 28 May 2020, the European Commission put forward a proposal concerning the European Fund for Sustainable Development (EFSD) in order to expand its coverage and raise the funds dedicated to leverage private investment for sustainable development and the guarantees to de-risk such investment. On 21 July 2020, the European Council rejected the draft amending budget that would have provided increased EFSD funding for the current year.
