Special Advisers to the Commission (2014-2019)

This study proposes an overview of the selection of Special Advisers to the European Commission, specifically during the period 2014-2019: the procedure followed, number of contracts, safeguards, contractual terms, budgetary implications, transparency, communication with the European Parliament. A review of literature, good practices and criteria for assessing the European Commission framework is provided. In conclusion this study makes recommendations on how to further strengthen it.

On 10 December 2020, the European Council reached an agreement on the implementation of the regulation linking EU funding to respect for the rule of law. Hungary and Poland, in opposing this new mechanism, had been blocking the Union’s new budget but have now agreed to a compromise. The regulation on the rule of law is part of the package on the multiannual financial framework (MFF) for 2021-2027 and the Next Generation EU recovery instrument. A panel at the 2020 ESPAS conference discussed how to create a sustainable economic recovery after the coronavirus pandemic. Robust governance is needed to get the most out of the new resources created at EU level. Both public funding and private capital are needed for the green transition. Public access to big data sets was identified as a critical issue, to prevent harmful monopolies. A poll of attendees identified dependence on fossil fuels as a key obstacle to a sustainable recovery.

Cooperation between the European Anti-Fraud Office and the European Public Prosecutor's Office

The establishment of the European Public Prosecutor's Office (EPPO) with the entry into force of the EPPO Regulation of 12 October 2017 requires the regulation governing investigations by the European Anti-Fraud Office (OLAF) to be adapted. In 2018, the Commission adopted a proposal to revise the OLAF Regulation as regards cooperation with the EPPO and the effectiveness of OLAF investigations. On 29 October 2020, the Polish government proposed the nomination of Marek Opioła, as a candidate for membership of the European Court of Auditors (ECA). There is currently no Polish member of the ECA, since Janusz Wojciechowski took office as European Commissioner on 1 December 2019. The European Parliament's Committee on Budgetary Control (CONT) held a hearing with the nominee on 7 December, and subsequently delivered an unfavourable opinion.
