Deficits in human rights compliance, democratic and judicial oversight of the current EU external migration policy should be addressed in the New Pact on Migration and Asylum. Based on an analysis of hard- and soft-law EU external migration policy tools and four case studies, the paper, requested by the Human Rights Subcommittee, reveals that the full effect of the EU fundamental rights acquis in extra-territorial situations has not been duly accounted for, and proposes a new compliance system.
